Terms and Conditions
MystiClouds Hosting will be referred to as MystiCloud in this document.
1. Ordering
1.1. Clients are not required to make a payment at the time of placing an order.
1.2. Clients are not bound by any long-term commitment and may discontinue payments at any time.
1.3. Orders will be delivered within the timeframe specified on our website, subject to stock availability.
1.4. In the event that the server is out of stock, it will be delivered within 8 days, or a refund will be issued.
1.5. MystiCloud will attempt to maintain adequate stock levels at all times.
1.6. Pre-orders are non-refundable.
2. Game Server
2.1. If the customer does not renew the server, MystiCloud reserves the right to shut down the server upon expiration.
2.2. If the customer does not renew the server, MystiCloud reserves the right to delete all data associated with the server upon expiration.
2.3. Support for plugins, resources, and code is not guaranteed.
2.4. MystiCloud is not liable for any data loss. Clients are responsible for creating their own backups.
2.5. The fair use policy for storage is 10GB per 1GB of RAM. If this limit is exceeded Mysticloud is allows to view contents of your server to evaluate if it is being missused.
2.6. The fair use policy for bandwidth is 100GB per month per 1GB of RAM rented. Enforcement of this limit will be assessed on a case-by-case basis.
2.7. While servers may be used to proxy to non-MystiCloud servers, this traffic counts towards the fair-use traffic limit. Bandwidth from proxies to MystiCloud-hosted servers within the same region is not counted. Clients will be notified if they exceed the fair-use soft limit.
3. Dedicated Servers
3.1. Clients are prohibited from hosting illegal programs, content, or websites.
3.2. Clients are prohibited from sending spam from their MystiCloud servers.
3.3. MystiCloud is not liable for any data loss. Clients are responsible for creating their own backups.
3.4. MystiCloud does not provide support for third-party applications but may offer guidance.
3.5. MystiCloud reserves the right to suspend the server if any illegal activity is detected.
3.6. Clients are prohibited from using their dedicated server as a proxy or to tunnel traffic to servers outside the MystiCloud network.
4. Support
4.1. Clients can open a ticket in our Discord, WHMCS billing area or send an email to support@MystiCloud.com for any service-related inquiries.
4.2. The official (non-SLA) response time of MystiCloud is 24-48 hours, though responses may be faster in practice.
4.3. MystiCloud only offers support for services provided by MystiCloud.
4.4. MystiCloud does not provide support for third-party software.
5. Refunds
5.1. By placing an order, the customer acknowledges that MystiCloud does not accept refund requests that are not covered by our refund policy.
5.2. Clients are entitled to a refund if MystiCloud services have an availability of less than 95%, due to technical issues on our side.
5.3. Downtime caused by customer misconfiguration does not qualify for a refund.
5.4. Clients must report technical issues to MystiCloud support via our Discord server, ticket system or email and allow sufficient time for resolution.
5.5. Refunds will not be granted lack of client knowledge. Clients are responsible for the installation and configuration of any programs or plugins on their server.
5.6. Refunds will be processed within 7 business days.
5.7. Some countries have a legal period during which clients can terminate their server without providing a reason, known as the Right of Withdrawal. By placing an order with MystiCloud, clients agree to waive this right.
5.8. Clients may not request a refund through payment services such as PayPal by submitting a claim. Refund requests must be made through MystiCloud support.
5.9. If a customer initiates a dispute through any payment gateway, including but not limited to PayPal or credit card providers, MystiCloud may immediately terminate and delete the customer's services without warning.
6. Other Obligations of MystiCloud
6.1. MystiCloud is not responsible for the content that the customer is hosting.
6.2. MystiCloud will remove illegal content or other illegal applications/scripts that are not permitted by law.
6.3. MystiCloud is not responsible for data loss in any case.
7. Force Majeure
7.1. Neither party is obligated to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure includes, but is not limited to: war, riots, strikes, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to telecommunications or electricity networks, cable breaks, network/server attacks including DDoS and DoS, disruptions in essential networks, disruptions in communication connections, or prolonged non-compliance by suppliers on whom MystiCloud depends.
8. Changes to Terms and Conditions
8.1. MystiCloud reserves the right to change the terms and conditions at any time.
8.2. MystiCloud will announce any changes in via suatable medium such as discord.
9. Community Support
9.1. MystiCloud is not responsible for any actions taken by the community.
9.2. MystiCloud is not responsible for data loss in any case.
9.3. MystiCloud does not provide support for third-party software.
10. Additional Provisions
10.1. MystiCloud reserves the right to terminate services if the customer violates any terms outlined in this document.
10.2. Clients must comply with all applicable laws and regulations when using MystiCloud services.
